A Hong Kong cook has been jailed for 18 years for persistently sexually abusing the daughter he shares with his mistress, with the presiding judge also criticising the victim’s mother for trying to keep her silent.
The High Court on Wednesday said a deterrent sentence was necessary for the 61-year-old to reflect society’s abhorrence of the “evil” crimes he committed against the girl when she was aged 11 to 18.
The accused, identified only by his initials, TML, to protect his daughter’s identity, pleaded guilty last year to six counts of rape and three of indecent assault.
The married man is a father of six, three of whom were born to his mistress from mainland China.
He has three previous convictions, including one for indecent assault in 1987, but had never been jailed before this case.
The court heard the defendant raped his daughter, referred to as X, and molested her twice at her home in Haifeng county, Guangdong, in May and June 2015, when she was 11.
He gave the girl three 100 yuan banknotes as “pocket money” after the assaults, but she refused.
He went on to rape X five more times and assaulted her once between September 2021 and March 2022, after she began staying at her elder brother’s flat in Hung Hom to pursue interior design studies.
Three of those incidents took place when X was unable to leave the flat due to a 14-day home quarantine requirement during the Covid-19 pandemic.
The girl disclosed her father’s abuse to her mother in April 2022. The mother, initially angry, told X not to report the matter to police to protect her reputation.
In a final cry for justice, the teenager left a note detailing the abuse before attempting suicide in October 2023. Police arrested the defendant on the same day she was rescued.
A victim impact report revealed the lifelong psychological harm suffered by the complainant, now 22.
Clinical psychologist Chan Sin-ting of the Social Welfare Department said the defendant’s acts were systematic, calculated and intrusive, noting he had exploited every opportunity to violate his daughter during the vulnerable developmental stage of her life.
“He single-handedly turned her home into a place of fear and threat,” Chan was cited as saying.
The court heard that X quit school and retreated into the digital world, avoiding contact with others.
After arriving in Hong Kong, she remained profoundly isolated, struggling to form friendships and maintain social ties, and often experienced mood swings and difficulty concentrating at work.
While she had hoped her elder brother would provide protection, he misinterpreted the defendant’s conduct as paternal affection, reinforcing her fear that disclosure would lead to disbelief and dismissal.
The report also said the victim’s mother failed to show sufficient concern for her daughter’s well-being. The victim felt despair when her mother invalidated her account of the defendant’s acts and prioritised familial stability over justice.
Even at the time of the assessment, X remained ambivalent about reporting her father to authorities, knowing his financial support was critical to her family.
Chan said X required intensive, trauma-specific psychotherapy to recover.
Madam Justice Esther Toh Lye-ping said the facts of the case were “deeply painful and heartbreaking”.
“Every parent in our community will find this case abhorrent. I must say the mother of X should also be thoroughly ashamed of herself for putting financial concern above [her daughter’s] well-being,” Toh said.
“I recognise also that no matter how long the imprisonment of the defendant, it will never be sufficient to compensate Ms X for the pain and abuse she has suffered.
“However, the sentence has to reflect society’s abhorrence for these offences and send a message that the court stands ready to protect the vulnerable children in our community.”
The court jailed the defendant for 12 years and 1½ years for each count of rape and indecent assault, respectively, before ordering a partially consecutive sentence, for a total of 18 years.
In Hong Kong, rape carries a maximum sentence of life imprisonment, while indecent assault is punishable by up to 10 years behind bars.
